The book leans more toward his side, claiming he's a good man who made a mistake. However, the film sympathizes more with Smith, giving her a narrative and telling the story through her perspective. After all, she was the victim of murder, and he was the one who committed it.
It might seem like an odd thing for the film to make up, but just because a film says it's based on a true story doesn't mean anyone should take it as a fact. Even if Above Suspicion kept Smith's name, her character, and her character's story is pretty fictional.
