Gennaco added that “it was one of the worst events regarding system failures” in his 20 years as a police auditor, and “one of the most concerning events I’ve had to write about.” According to the report and his lawsuit, in August 2019, Nuñez was being held in the Acute Psychiatric Unit of the Main Jail in San Jose when he ran headfirst into a wall in his cell after which he fell to the ground and soon after screamed for deputies’ help, saying he feared he might be paralyzed. He lay on his back for an entire day as food trays piled up after they were inserted into his cell, and the only look he got from deputies was to ensure he was breathing.
He suffered permanent injuries, including spinal cord injuries that have left him a quadriplegic, unable to communicate, and in need of a ventilator to breathe. The OIR report faulted a host of structural and cultural issues at the jail that underpinned what happened to Nuñez. That prompted an array of recommendations from the monitor, including specially recruiting deputies for the psychiatric unit who have the correct skill set and temperament to work there, and pay a premium to ensure the right people are in place.
