According to the suit, delivery driver Jason Agee was operating a half-ton rolling cart containing cases of bottled water on a delivery ramp.As the cart was being rolled over it, the ramp gave way on deteriorated gravel, causing Agee to fall. As a result, Agee suffered a torn rotator cuff, a broken toe, and other permanent injures that required two surgeries and left him needing intense physical therapy, his lawyers said.
