Alameda tax to raise teacher pay struck down in court ruling

Alameda Unified is still committed to paying the teacher raises it has agreed to.

ALAMEDA — Measure A, a school parcel tax voters narrowly approved in 2020, has been struck down in court, but Alameda Unified says it plans to appeal the ruling.

Under the measure, property owners were taxed 26.5 cents per square foot of their building, with an annual cap of $7,999. Trainman contended that the tax was unfair because larger businesses such as the Lucky Supermarket on Marina Village Parkway were taxed less per square foot than smaller businesses and residences.

“As sympathetic as this court may be to the desire to raise additional funds to support schools and quality education for students, it is nonetheless duty-bound to uphold the provisions of the California Constitution,” Spain wrote in her official decision. The judge ruled that the parcel tax created unequal taxation, a violation of Government Code 50079.

Alameda Unified spokeswoman Susan Davis said the district is still committed to honoring the salaries it has already agreed to, including a 9% raise that was negotiated in the 2019-20 school year and a 2% raise last month. “We are disappointed in the Superior Court’s decision,” Alameda Unified wrote in an emailed statement sent by Davis. “We continue to believe this measure is legal, however, and we know that this revenue is crucial to our being able to attract and retain high-quality teachers and school employees.”
