What will the magistrate have to consider in deciding whether Julian Assange is to be flown across the Atlantic to face his accusers in America?

Julian Assange will tomorrow emerge from his coronavirus lockdown in London's high-security Belmarsh prison to face an extradition hearing at the Old Bailey.Julian Assange's extradition hearing resumes on September 7 after long delays due to the coronavirus

Comprising some of the UK's most-respected silks, Mr Assange's defence team will attempt to persuade the court he is unfit to travel to the US to face trial, and that the attempt to send him there is essentially an abuse of process.

"His resolve to protect himself from US extradition had a serious toll on his health because of the British authorities' refusal to allow him to seek medical attention outside of the embassy without facing arrest."If the court accepted that, it could open up the possibility of protecting Mr Assange in the UK under European human rights law.

"The United States is saying that if you receive and publish US information, we will prosecute you in the United States and seek your extradition from wherever you are in the world," she said. "It's most unlikely that it will be finally determined by the magistrate's court, but most likely make its way on appeal through the UK court system."If Mr Assange is extradited to the United States and he is found guilty, he faces a maximum 175 years imprisonment for the 18 offences listed in the indictment.

Some Assange supporters believe that the decision by the US Government to list the Rules of Engagement in the indictment but not the video was deliberate. "I saw it on MSNBC first and when I saw the title of the video, and my feet went out from under me and I fell down onto a chair behind me. And I just remember saying, what the f***? And I … I was looking at it. I was just completely stunned."
