Now SB 519 would create the position of director of in-custody death review, a six-year term appointed by the governor subject to state Senate confirmation

Amendments to the initial legislation also require the new director to issue a report within 90 days of any jail death, noting how the Sheriff’s Department handled the death investigation and making any policy recommendations that might improve jail operations.

“This bill remains laser-focused on creating more transparency, accountability, and oversight for local detention centers across the state,” she said Friday.“But we have had productive negotiations with the administration, with the support of advocacy groups and stakeholders, and as a result of those discussions, we have a solution that will create progress on what is happening in our jails and local detention facilities,” Atkins said.

“It’s not necessarily watered down, but it’s been shifted so we can get it past law enforcement objections,” he said. “I don’t love it, but it’s necessary.” Multiple plaintiffs have sought the records as part of the discovery process of civil litigation, and at least three federal judges have ordered the records to be released publicly. But Sheriff Kelly Martinez has withheld the records and appealed their public release.
