Biden Officials Hope To End Brittney Griner Russia ‘Hostage Crisis’

“Americans should view Brittney Griner’s detention as a hostage situation,” _danigilbert, an expert on international hostage situations, told our contributor Stuart Anderson. They discussed what the U.S. can to bring Griner and Paule Whelan home.

I’m very careful about using “hostage” terminology, so I don’t come to this lightly: Americans should view Brittney Griner’s detention as a hostage situation. According to the 1979 International Convention Against the Taking of Hostages, a hostage-taking comprises an ongoing intention “in order to compel a third party . . . to do or abstain from doing any act as an explicit or implicit condition for the release of the hostage.

State-led hostage-taking, or what I’d call hostage diplomacy, intentionally makes this classification challenging. Perpetrators use their criminal justice system and the color of law to feign legitimacy, when instead they’ve turned their criminal justice apparatus into a hostage-taking enterprise.An individual hostage crisis ends when the victim is released and can return home. So, in that sense, Brittney Griner’s hostage situation will end once she’s safely back on U.S. soil.

The administration’s recent announcement that they had made Russia a “substantial offer” to bring Griner andhome helps advertise what I had assumed previously: that they are working hard behind the scenes to try to bring our citizens back. I hope that these negotiations are successful, though there’s likely to be more twists and turns ahead.
