The Supreme Court heard David Barker had been issued a notice of eviction in February by the housing department, which claimed he was hoarding hundreds of kilos of plastic in his front year. Barker unsuccessfully appealed that notice through the Queensland Civil and Administrative Tribunal .After losing the QCAT appeal he was issued an eviction warrant and due to leave the public housing home on Friday, which was on Monday surrounded by supportive protesters.
The disability pensioner was granted a last-minute hearing in the Supreme Court today after it was revealed to lawyers for the housing department that he may have been denied procedural fairness.Instead, protesters surrounded his property and he was granted a last minute Supreme Court hearing. "I'm not a hoarder, no. We've gone through this before with the psychologist and we've decided I don't meet the conditions," Barker said.
