The Catholic Church has won a High Court appeal against rulings it was vicariously liable for alleged sexual abuse by a priestThe Catholic Church has won a High Court appeal against rulings it was vicariously liable for the actions of a priest who allegedly sexually abused a five-year-old in 1971.He was awarded $200,000 when two earlier court rulings found the church was vicariously liable for the harm caused by Father Coffey.
The church appealed and lost and then took the matter to the High Court saying it was only vicariously liable if there was an employee-employer relationship, and that wasn't the case for Coffey. The court heard the man had had a difficult life, plagued by depression which he put down to the abuse, although he also didn't tell his psychologists over the years.
