It also said the judge was wrong to find its officers had each held their own pickets – meaning it should not be penalised for multiple illegal acts – as the “collective nature” of the protest meant it was actually a single event. But the ABCC pushed back on the CFMEU’s attempt to reduce the fine, saying that while the judge needs to consider these factors in sentencing, they have discretion as to how much they do so.
