Charges against a man accused of slapping Rudy Giuliani on the back have been downgraded from second-degree assault to misdemeanor assault with intent to cause physical injury.
Daniel Gill, 39, an employee of the ShopRite supermarket in Staten Island where Giuliani was campaigning for his son on Sunday, was initially charged by police with second-degree assault.
Legal Aid, which is representing Gill, characterized the encounter as merely a pat on the back — not a dramatic slap. He said Monday that he stopped at the ShopRite to campaign for his son, Andrew, who is running for the Republican nomination for governor of New York, and that he was talking to people when he felt the smack on his back. In a video on his Facebook page, he described it as if “a boulder hit me” and “it hurt tremendously.”
He said the suspect yelled “dirty curse words” at him and accused him of being a “lady killer,” touching upon the, a decision that eliminates the broadly supported constitutional right to abortion.
