An Aboriginal elder says a fine handed to City of Kalgoorlie-Boulder will not deter others from damaging Aboriginal heritage sites.
The City of Kalgoorlie-Boulder has been fined $5,200 after damaging a registered Aboriginal heritage site.
The council had not received approvals from Aboriginal Affairs Minister Tony Buti or the Registrar of Aboriginal Sites to start work at the site, known as Mulyinyu Rockhole. It was also fined $200 for bringing machinery onto Crown land without the approval of the relevant minister or registrar. Magistrate Gibbs criticised the city for its "failure" to conduct basic checks after hearing WA's online registry of Aboriginal heritage sites was not consulted before the works were completed.
"In my view, that policy should have been in place before the offences, so when that person is on leave, somebody else takes responsibility for that," Magistrate Gibbs added.She granted a spent conviction on both charges, noting it was a first offence and the council was otherwise "a good corporate citizen", contributing to various Indigenous initiatives throughout Kalgoorlie-Boulder.
