The NSW Supreme Court hears the 27-year-old accused believed the 61-year-old father was armed when he fatally kicked and punched him.
Connor Fuller , 27, pleaded not guilty in December 2022 to the murder of 61-year-old Mark Tozer at South West Rocks in 2021.
Mr Tozer was airlifted to hospital in Newcastle after he was found with serious head injuries on Albert Harrower Crescent in South West Rocks on July 28, 2021.During opening statements on Monday Mr Fuller's defence solicitor, Michael King, said his client would plead guilty to manslaughter over an "excessive" act of self-defence."It was more than simply Mr Tozer chasing him back to his house," Mr King told the court.
Mr King also told the court that it would need to be determined whether there was a side-swiping incident. Mr Costello told the court that in one phone call Mr Fuller could be heard saying "If they don't f***ing let you walk away you flog them — he got a hiding and it's not my f***ing fault he f***ing died".
