Constitutional expert and legal academic warns about Indigenous Voice proposed wordingRespected constitutional expert, law professor and human rights lawyer Father Frank Brennan has warned of ten years of court challenges if the current proposed wording for the Voice to Parliament proceeds. He says the Prime Minister’s process so far has been dead wrong, urging greater transparency and consultation from the government. Fr Frank has written a book on The Voice, and he’s proposing an alternative form of words for a constitutional amendment. It reads: “There shall be an Aboriginal and Torres Strait Islander Voice with such structure and functions as the Parliament deems necessary to facilitate consultation prior to the making of special laws with respect to Aboriginal and Torres Strait Islander peoples, and with such other functions as the Parliament determines.” He argues the PM’s proposed language would be open to challenge and must be made “watertight” if the referendum is to succeed. Asked about Father Frank’s intervention, the Prime Minister maintains he’s keeping an open mind and is not being prescriptive on what the constitutional amendment should say. “We’ve got a constitutional working group that is working through these issues, including former High Court Judge Justice Hayne and Professor (Anne) Twome,” Mr Albanese said. “Fr Frank Brennan is a friend of mine, he has my utmost respect. He’s someone who is a very good person. The Calma-Langton review wasn’t just Calma and Langton, Prof Brennan was a part of it. “I don’t have a closed mind on these things, but I think the constitutional working group that has been established is working through these issues as well.”
