A country club in Willoughby is the center of more legal action, the Kirtland Country Club once again drawing attention due to the skeet shooting that happens from November to April.
“Over the many years, the residents, hundreds, have petitioned the club with gut-wrenching stories of suffering, and each time, the club says, ‘Well, we’re within the law; we’re allowed to do this,’” said attorney Tim Misny, who is representing residents taking the club to court. “Hearing about a Vietnam vet who has post-traumatic stress disorder and every time he hears the shooting, it triggers flashbacks of firefights in which he lost his dearest friends; that wasn’t enough for them.
Misny announced Thursday morning the class-action lawsuit cites issues with the noise and safety concerns brought by the people living near the club, concerns they have Misny said it is something that plagues people in the area for 10 hours every weekend during the golf off-season.He said while the club received a permit years ago to allow for shooting in the city limits, adding the club is not adhering to the conditions of the permit.
“Next week, I am filing in Federal District Court. The city failed miserably, and the state failed miserably,” said Misny.Lucas notes the city has been taken to court over Kirtland in the past, with the Lake County courts siding with the city back in 2019.The Kirtland Country Club has successfully defended itself against a number of similar cases over the past years. We were successful in both the trial court and court of appeals.
