A hospitality worker says he found Mount Macedon man William Herbert Swale with his eyes closed and mouth open behind the wheel of his smashed car after the fatal crash.

A driver who hit and killed five Daylesford pub patrons was found looking very unwell and with eyes closed behind the wheel of his car after the fatal crash.

“He entered store, I spoke to him briefly, he asked for a seat. We 100 per cent didn’t have any seats, we were totally full, that was the extent of our conversation,” Hinck told the court. Swale, who is on bail, appeared in court in person seated behind his barrister Dermot Dann, KC, and next to his wife and children.
