Loury’s written judgment laid out police “failures” to conduct basic investigations into the incident, and said explanations for those failures were “entirely unsatisfactory”. Police located the steering wheel lock in the complainant’s room, but did not seize the item as evidence or conduct a forensic examination.Senior constable Brooke Mair, who took over the investigation into the incident about nine months later, collected CCTV evidence from nearby homes.Under cross-examination, Mair was asked why police had not obtained statements from multiple people who might have been able to shed light on whether the boy was present.

“[Mair] confirmed that she spoke to the complainant’s brother to try to get a statement from him. In the end, she did not bother as it was too hard with her rosters to obtain a statement from him.
