The battle over abortion-by-mail pills continues with the DOJ saying the U.S. Postal Service can deliver.
The Department of Justice has cleared the way for the U.S. postal service to delver so-called abortion pills.The Department of Justice’s Office of Legal Counsel has announced that the abortion pills, Mifepristone and Misoprostol can be mailed to people in all states – including those like Texas that have restricted abortion access., written by Assistant Attorney General Christopher Schroeder, Schroeder writes that mailing these prescription drugs through the U.S.
Because the delivery of these medications has been ruled legal by the DOJ, the responsibility falls on the person receiving these prescriptions.Many packages that may contain prescription drugs are sealed against inspection under federal law and therefore the Postal Service lacks knowledge of the specific contents of such packages.
Back in 2021, the Food and Drug Administration confirmed this as they took away the requirement for these medications to be administered in person at a clinic and allowed them to be distributed by select pharmacies following either in-person or telehealth consultations. The companies have not announced when they would begin or finish the certification process. They also have not indicated how many of their pharmacies will be distributing the medication. Both pharmaceutical companies have mentioned that their distribution will coincide with federal and state laws.
18 states, and people in those states – mostly in the South and the Midwest – are disproportionately affected by abortion bans and restrictions. And those most affected are Black people, people of color, young people, and rural communities. Because of Senate Bill 8, in response to the DOJ’s ruling, Texans can expect to see cases challenging the decision to take place in courts across the state.
