A gag order barring Donald Trump from making public statements on a civil fraud case has been expanded to include his lawyers, while a separate order in a federal criminal case has been temporarily paused.
A judge has issued an expanded gag order in the New York state civil fraud case against Donald Trump, while a federal appeals court temporarily lifted similar restrictions in a criminal case.Mr Trump has twice breached the order and been fined $23,000The order issued by Justice Arthur Engoron of the New York state court in Manhattan bars public statements by lawyers in the case about the judge's communications with his staff.
"The First Amendment right of defendants and their attorneys to comment on my staff is far and away outweighed by the need to protect them from threats and physical harm," Mr Engoron wrote, referring to the US Constitution's free speech protections.Donald Trump had put his two sons in charge of his real estate empire while he served as US president from 2017 to 2021, but they both say they had no involvement with the documents at the centre of the fraud trial.
The order says the temporary pause "should not be construed in any way as a ruling on the merits" of the appeal for a longer one.Mr Trump's lawyers have argued the order violates his free speech rights under the US Constitution's First Amendment but an attorney has declined to comment on Friday.It's the most serious restriction a court has put on the speech of the Republican presidential primary frontrunner and criminal defendant in four separate cases.
Mr Trump's lawyers say they will go to the Supreme Court, if necessary, to fight what they say are unconstitutional restrictions on his political speech.
