Douglas County school board weighs appealing judge’s order prohibiting one-on-one meetings, citing precedent

The deeply divided school board overseeing Douglas County School District spent Friday morning arguing whether to appeal a judge’s preliminary injunction prohibiting directors from having one-on-one meetings to privately discuss district business.

Ultimately, after more than an hour of discussion, the Board of Education decided to table the decision until their regular board meeting on March 22. But the stakes of the decision to appeal the injunction, and the overall case, were made clear by board president Mike Peterson, who said he was “concerned about the precedent being set.”

In order to appeal the decision, she said, the board’s legal team would have to make the argument that “we would actually like to have the ability to make decisions that are not in a public forum. Spending tax dollars to fight this is absurd,” Hanson said. “In our view, it’s been the case with the open meetings law you can not circumvent the quorum requirement in order to meet another away to collectively discuss a particular matter of public business and then come to a conclusion about it,” he said. “Otherwise, what is the point of having the open meetings law?”holding series of one-on-one meetings to discuss district business privately
