Mr. Duggan, a former US Marines pilot, was slated for extradition by February, but this timeline is now on hold pending the outcome of a judicial review. Mr. Duggan faces accusations of violating arms trafficking laws by training Chinese pilots in 2010 and 2012.
His wife, Saffrine Duggan, released a video statement expressing the family's deep concern and their decision to pursue legal action. 'We have been forced to resort to court action today because the government has not been transparent about this case,' Ms. Duggan stated in the video. 'Despite Dan being locked up in maximum-security prison for the past 26 months with no Australian charges,' she emphasized, highlighting the lack of clarity and the prolonged detention without charges within Australia. Saffrine Duggan further conveyed the family's sentiment of being 'forced' to challenge the extradition, stating, 'We are an Australian family and we deserve a fair go.'Under the Federal Extradition Act, the extradition process is now paused until the judicial review is finalized. In December, Australia's Attorney-General, Mark Dreyfus, revealed that Mr. Duggan was deemed eligible for surrender to the US by a NSW magistrate.
