Editorial | 'Justice Samuel Alito’s draft opinion is not sound jurisprudence. It is political whimsy, and politicians should not serve on the U.S. Supreme Court.'

Justice Samuel Alito’s draft opinion is a daft display of hubris. Alito clearly thinks he is wiser than 50 years of collective majority opinions written by the finest legal scholars this country has ever seen.

We are shocked that Alito would bend so easily on his refusal to confer rights that are not expressly included in the Constitution. He uses a good deal of his opening argument saying that there is no mention in the Constitution of abortion.

That’s true, and we could see how someone who was dedicated to not giving U.S. citizens rights that aren’t expressly conferred by the actual language and text of the Constitution could find it impossible to support Roe vs. Wade. It, therefore, should be impossible for a serious justice to oppose Roe vs. Wade and also support Griswold vs. Connecticut, yet here is Alito trying to do so in a draft opinion that he wants other legal scholars to sign off on.
