The NSW Court of Appeal is considering whether to overrule the prime minister’s selection of three Liberal MPs without a vote of members.

The formal start of the federal election campaign may have to wait for three NSW judges to decide if Prime Minister Scott Morrison isOn Friday, the NSW Court of Appeal considered a request from Liberal Party member Matthew Camenzuli to overrule the selection of three Liberal MPs, Environment Minister Sussan Ley, Immigration Minister Alex Hawke and backbencher Trent Zimmerman, without a vote of party members.

“These effectively change the rules such that selections are no longer performed by the general membership and decided by three individuals,” he told the court. One of the judges, John Basten, asked Mr Reynolds to define the meaning of a clause in the Liberal Party federal constitution giving it control over the party’s federal affairs.Justice Basten responded: “I was inclined to think that it might include federal elections.”Mr Robertson told the court the selection of candidates for federal elections was a “state affair”.
