A two-year-old Indiana law has made the state more vulnerable to flooding and environmental damage, according to a group of environmental organizations.
Two years ago, the Indiana General Assembly passed Senate Enrolled Act 389, which eliminated the requirement to get a permit for disturbing or filling certain wetlands in Indiana and reduced the permit requirements for others.
The state also has lost the water purification service that those wetlands provide for free, environmentalists say. The Supreme Court said wetlands protected by the EPA must only be those adjacent to a “relatively permanent” waterway “connected to traditional bodies of water.” “The distinctions are kind of artificial,” she said. Even wetlands not next to a river or lake “are often connected via groundwater,” and an isolated wetland “still soaks up a lot of stormwater and recharges the groundwater.”Before the Supreme Court ruling, Frank said, only about 20% of Indiana’s wetlands were under Indiana’s jurisdiction and the rest under federal rules. Now the balance has flipped, with 80% under state jurisdiction.
Gary Brown, president of the Porter County chapter of the Izaak Walton League, says it’s time to reverse that trend.
