Former High Court chief justice Robert French has backed the draft changes to the Constitution that would establish the Indigenous Voice to parliament, calling it a “sensible and straightforward proposal”., Mr French welcomed “the opportunity” the Voice created for better policy development, without usurping the authority of parliament.

“It leaves it to the Parliament to legislate for the Voice a model which it thinks is best suited to the Constitutional function. Parliament can alter the legislative model in the light of experience. The proposal does not create a third chamber [of parliament].”on Saturday, in which he revealed the question to be asked at a referendum and a draft text for what would become section 129 of the Constitution.

The Aboriginal and Torres Strait Islander Voice may make representations to Parliament and the Executive Government on matters relating to Aboriginal and Torres Strait Islander Peoples. The text adopted by the PM came from the co-chairs of the Uluru Dialogue – Pat Turner and Professor Megan Davis – in conjunction with Cape York leader Noel Pearson, and University of NSW legal academics Sean Brennan and Gabrielle Appleby.Indigenous advocates Megan Davis, Pat Anderson and Noel Pearson with a piti holding the Uluru Statement from the Heart, which called for a Voice to parliament.

Mr French declined to comment on that aspect of the debate, but his comments about it not being a third chamber were a direct riposte to those – such as former Prime Minister Malcolm Turnbull – who have described the Voice in that way.
