Borg, who was a senior constable, pleaded guilty to two counts of common assault and failed to have the charges dismissed on the grounds of mental health issues, including depression and anxiety. In the NSW District Court, Judge William Fitzsimmons dismissed Borg's appeal against his conviction and found that the 10-month correction order was a suitable sentence to let Borg get the treatment he needs in the community.'It was entirely unprovoked'
He rejected the contention that the magistrate who sentenced the offender erred in giving too much weight to the seriousness of the offences.
