The workplace tribunal has slammed a CFMEU official for his “appalling” abuse and intimidation of workers just a day after theThe Fair Work Commission suspended Queensland official Luke Gibson’s permit to enter work sites for five months on Monday because he had sworn at workers, asked them to fight him and engaged in “blatant flouting” of safety rules onCFMEU Queensland organiser Luke Gibson was found by a court this year to have behaved in an “appalling manner” on site.
On the Gold Coast project in 2020, the Federal Circuit Court found Mr Gibson had entered builder RawCorp’s excluded zone without authorisation and stood behind trucks to block their concrete pours. The judge found nothing could justify Mr Gibson’s “appalling” behaviour, which had prompted an employee to call the police, and said he acted as if “those rules don’t apply to us and we can do whatever we want”.Considering the ABCC’s bid to suspend Mr Gibson’s entry permit, FWC deputy president Val Gostencnik said the official had offered no contrition and his union had not disciplined or counselled him despite a $10,000 fine.
