Due to financial and time constraints, native title bodies often struggle to file compensation claims before elders with vital knowledge die, but a new Federal Court decision allows their testimonies to be collected and preserved for future claims.

A landmark court decision has allowed Indigenous elders in northern WA to have their testimonies and evidence collected and preserved for future compensation claims.

The evidence is being pre-recorded for use in future compensation and native title cases, the first time testimony has been gathered prior to a claim being lodged.Karajarri and Yawuru man Joe Edgar and four of his siblings shared personal experiences and stories passed down about their family, and how their country had changed and been impacted by government policy.

Kimberley Land Council chief executive Tyronne Garstone said the complex system of filing compensation claims meant native title bodies were often incapable of doing so before elders died, risking the loss of their valuable knowledge.
