Former West Australian Nationals MP James Hayward has convictions for sexually abusing a young girl set aside and will face a retrial.
The Court of Appeal ruled he was successful on one of the four grounds of his appeal and that his two convictions would be set aside.A former West Australian Nationals MP has had convictions for sexually abusing a young girl James Hayward now wants to be reinstated to state parliament and have the opportunity to deliver his valedictory speech under parliamentary privilege.
Mr Hayward represented himself in court and showed no visible sign of emotion as the ruling was handed down.But Mr Hayward had claimed in his appeal that he had a "strongly arguable case". He reiterated his argument he had not received a fair trial and claimed the court's decision indicated there had been a "miscarriage of justice".
