have been drawn, with a former Supreme Court judge predicting that Nicola Sturgeon’s chances of success in court were “very low”. Lord Hope said the UK Government’s statement of reasons for using a Section 35 order to veto the Bill passed by MSPs before Christmas was “devastating” for the Scottish Government.
However, former UK justice secretary Lord Falconer said he thought the UK Government’s reasons for deploying the previously unused blocking mechanism were weak, describing the move as “a nuclear weapon used in a minor skirmish”. The Scotland Secretary confirmed to the Commons on Tuesday he would be vetoing the Gender Recognition Reform Alister Jack argued that having two different regimes within the UK would undermine equalities legislation, a policy area on which only Westminster is allowed to make laws.
