Seventeenth Judicial District Attorney Brian Mason, in talking about the Commerce City deaths said, “no drug is safe, because any drug could literally have fentanyl in it without the user knowing. We’re finding it in cocaine, we’re finding it in heroin, we’re finding it meth. In limited cases, we’re even seeing it with marijuana.” Many believe they are buying a Percocet, Oxycodone or Xanax.

Gov. Jared Polis announced in January that he would work to strengthen laws around prosecuting fentanyl dealers. This legislation is in the works but has not been introduced yet. After all, prosecutors have the discretion to plea bargain cases to a misdemeanor when the facts dictate a different result. Currently, however, there is no such leverage and at best, people charged with a higher amount of fentanyl may get a slap on the wrist.
