Ger Treacy invokes Human Rights Act as he tells councillors he will lose over £45K a year
A Gaelic sports commentator and prominent Stormont civil servant has complained to Belfast Council that he will have to give up two properties after losing his status as a HMO landlord.
HMO licence renewal cannot be refused on the basis of overprovision of such properties in an area, but new licences can be refused on this basis. The three licences at 23 Ireton Street expired on September 4 2023. Again, reminder letters were sent to Mr Treacy by Belfast Council on May 17 2023 and August 21 2023 informing him of the need to renew the HMO licences at 23 Ireton Street before their expiry.
By February 2024, 88 percent of all dwelling units in policy area HMA Botanic, Holylands, Rugby were made up of HMOs and flats/apartments. 45 percent were licensed HMOs.He asked for elected representatives to treat his appeal “objectively and compassionately” and not to “rubber stamp” the council officers' belief the applications amounted to overprovision with refusals.
“My point is currently my two properties, and this is the truth, they just about wash their face, and are not making me any fortune.” He said: “Just from a basic human perspective, not to mention a human rights perspective I just don’t see how this committee can make such a decision, and live with the impact of that decision.” He said he would have “no alternative but to give up both properties as they would not be economically sustainable.
