Network Ten has urged the Federal Court to order the unemployed former Liberal staffer to pay security as the price of bringing an appeal.

Bruce Lehrmann has “had his day in court” and should not be allowed to appeal against a damning decision finding that he raped his former colleague Brittany Higgins unless he pays $200,000 in security, Network Ten has argued.

Dr Matt Collins, KC, acting for Ten, said Lehrmann had “no capacity” to pay the $2 million costs order against him, let alone any order for security for costs. This meant an order for security would “stultify” the appeal, Collins said.He said Lehrmann had “had a very expensive trial … conducted in the full glare of the entire nation” and was represented by experienced lawyers. The appeal raised no issues of law and Lehrmann had already had his day in court over the 26-day trial, Collins said.
