Harvey Norman and Latitude Financial have announced they will apply for leave to appeal against a court ruling they engaged in misleading conduct.
The case relates to advertisements on TV, radio and in newspapers between January 2020 and August 2021 in which the companies spruiked 60-month interest-free payments and no need for a deposit when buying high-ticket items from the furniture and electronics retailer. It found the advertisements' statement of the payment method was presented as a complete statement, when it was far from complete.
"Namely, a continuing credit contract with Latitude that was linked to a credit card , whether or not they wanted a credit card , which required them to pay an establishment fee and ongoing monthly account service fees in respect of that linked account.
