He said McCrow was not immediately killed after being shot, and he watched her “rolling around screaming out” but was unable to get to her. He fired just a single shot during the encounter, after Gareth Train executed constable McCrow at close range. Kirk said he did not shoot at him before this for fear of hitting the other officer, and because it was out of range.

Kirk described in court that the man swayed from side to side “trying to peer around the tree I was at”. He then ran back to his car.Justin Greggery, acting for the QPS Union, asked whether the incident might have gone differently if they were more heavily armed.
