Last year, the High Court found indefinite immigration detention was not legal. Now, two additional cases related to that decision are set to go before it.
Last year, the High Court overturned a a twenty-year-old ruling that indefinite detention was lawful.that found indefinite detention is not legal in cases where there is no prospect of removal in the foreseeable future.
Last week, the High Court found a law requiring former immigration detainees to be monitored by ankle bracelets and live under a curfew was not valid. He was sentenced to more than 10 years jail, and except for a time when he escaped and was free, went from jail to immigration detention in 2018. The pair will tell the High Court that since there are findings of "complementary protections" for both, and there is no prospect of removal to another country in the reasonably foreseeable future, their release from detention was inevitable, once their visas were processed, even if the visa was refused.
