Homeowners strike $16.1 million deal with D.R. Horton over claims of faulty construction

The class-action suit includes the owners of 220 single-family homes in the Rose Hill subdivision completed by D.R. Horton between 2012 and 2017. Homeowner Natalie Zitek’s initial 2019 complaint said water intrusion and consequential damage started shortly after the completion of the homes and have been occurring every year since.Lucey said this is one of the first class-action lawsuits that has handled multiple issues in a community of single-family homes.

The vast majority of the case was resolved by settlement after about a week and a half of trial this month, according to Lucey. The jury returned a $4 million verdict Sept. 15 against another subcontractor, and the homeowners also settled with mechanical, electrical and plumbing providers prior to the trial, according to court documents.For the most part, Lucey said, homeowners will decide what to repair or if they want to pass the repair money on to new buyers.

Lucey has been in construction litigation for decades. He said problems arise when site superintendents aren’t adequately trained or qualified to know whether subcontractors are doing their jobs properly.“It appears to me that, decades ago, the industry transitioned from homebuilding being a profession to homebuilding being a business,” he said.
