Many student hopefuls who have had their visa application rejected are appealing the decision, often as a means to extend their stay.
Already a subscriber? The number of prospective foreign students lodging appeals against having their visa rejected has more than doubled in nine months, swamping the national appeals tribunal.
“The AAT is struggling to keep up with the rapid increase in appeals against student visa refusals, despite additional funding,” Mr Rizvi said. The most recent Home Affairs Department data show that applications for student visas from people already in Australia rose to 34,388 in March, from 25,886 in March 2023.However, just 6834 were approved during the month, compared to 18,604 in March last year.Migration Institute of Australia chief executive Helen Duncan said there was no doubt a large proportion of people appealing were simply trying to extend their stay.
“The appeals process can take a very long time before an outcome can be reached with those people staying in Australia during the appeal.“If they lose, they can then appeal to the Federal Court. It’s obvious that some people are using it as an avenue to extend this day in Australia.”
