'It's my garden': Prominent developer defends changing heritage-listed garden without permit

Errol Stewart and his family company are facing charges over garden works at a heritage-listed Hobart property. Mr Stewart says the works were urgent, but the council says the works have damaged the heritage significance of the site.

However, a senior cultural heritage officer with the council, Sarah Waight, said the damage caused by the works had "caused detriment to the heritage significance of the site".

She said photos submitted of the works indicated evidence of trees damaged with heavy equipment, severed roots, disturbed soil, and the removal of plants and shrubs. Mr Stewart told the court he did not wait to get a permit because he was "concerned about the fire risk".Owner Errol Stewart said he did not believe he needed permission to remove vegetation from his property.
