A County Court of Victoria judge says she believes a man due to be sentenced after pleading guilty to dangerous driving causing death may have left the state.

Ms Smith, 53 had just finished work when she was killed in a two-car crash on the Western Highway near Stawell, western Victoria, on May 20, 2022. The driver, Mingen He, was due to be sentenced today after pleading guilty in September to one count of dangerous driving causing death. He was on bail, and required to report to a police station three times a week, which the prosecution said he had failed to do.Judge Kellie Blair told the hearing Mr He was last seen on Saturday, November 23, and was reported missing by his partner the following Monday.
Judge Blair said it was unlikely Mr He had fled the country given his passport was seized when he was charged, but she believed he was no longer in Victoria."I’m sorry you have travelled and I’m sorry you've been put out," she told the court.Ms Smith worked as a Victoria Police officer for 10 years before becoming a paramedic, and her friend Sharlene Hellewell described her as a "prankster" who was "always having a laugh".
