The case was brought by Students for Fair Admissions, a nonprofit group of Asian American students who were rejected by Harvard. They claimed that Harvard violated their civil rights by holding Asian Americans to a higher standard. The lawsuit was engineered by SFFA president Edward Blum, a conservative legal strategist who was also behind the landmark affirmative action caseThe case centered on Harvard’s “personal rating” metric. The SFFA claimed that Asian Americans were consistently given lower personal ratings due to racial bias and didn’t get into Harvard despite high test scores and GPAs.
The judge found that despite statistical differences in personal ratings, “to the extent that the disparities are the result of race, they are unintentional and would not be cured by a judicial dictate that Harvard abandon considerations of race in its admission process.”: “It is this, at Harvard and elsewhere that will move us, one day, to the point where we see that race is a fact, but not the defining fact and not the fact that tells us what is important, but we are not there yet.
