A California judge has ruled that a group of UK-based insurance underwriters do not have to pay out a claim to a concertgoer who was stabbed at a music festival in 2016.
was attacked while trying to stop a fight between other attendees at an event called Summer Jam in Lincoln, Calif. His original lawsuit alleged that the event’s promoters, WorldOne Presents, were negligent for not "providing security measures to prevent fights and guests from entering with dangerous weapons."
Pantoja's complaint stated: "During the concert a fight broke out between unknown individuals for which security personal working for defendant WorldOne Presents… failed to respond. As a result of defendants’ security personal failing to respond to individuals continuing to assault a victim, plaintiff attempted to stop the physical assault of a fellow guest and was stabbed multiple times by one of the perpetrators who had entered the concert with the deadly weapon.
He alleged that concert security failed to respond to the fight, and since organizers were "responsible for the hiring, supervision, and training of security" personnel, they were therefore on the hook for damages. After Pantoja filed suit, WorldOne attempted to claim on its policy, but the insurers -- who are affiliated with Lloyd’s Of London -- argued that such coverage is barred by an "assault and battery exclusion" contained in the fine print.
