Twenty years after she was convicted over the deaths of her four young children, Kathleen Folbigg has been pardoned and freed from prison after a landmark inquiry concluded there is reasonable doubt about her guilt.
NSW Attorney-General Michael Daley said on Monday that he had received the preliminary findings of the head of the inquiry, former NSW chief justice Tom Bathurst, KC, on Friday.It was Bathurst’s “firm view” that there was reasonable doubt about Folbigg’s convictions, Daley said, and his full report would be delivered at a later date.
“I think we all have to put ourselves in Ms Folbigg’s shoes and let her now have the space that she needs to get on with her life; not to harass her or pursue her in any way. It’s been a 20-year-long ordeal for her. [We] wish her well for the rest of her life.”Daley said he had notified Folbigg’s ex-husband Craig, and he was “thinking of him today as well; it would be a tough day for him”.
Bathurst offered to send his preliminary findings in advance of the final report, and Daley received those on Friday afternoon. The inquiry paved the way for her release from prison and potentially millions of dollars in compensation, either after a civil suit or paid by way of an ex gratia payment by the government. But Daley said on Monday that potential compensation was “getting well in advance of today’s story”.
This is the second inquiry into Folbigg’s convictions. A first inquiry, headed by former NSW District Court chief judge
