The Treasury department has more than 1000 documents in its possession which it classes as advice from it to Treasurer Jim Chalmers about changing the negative gearing and capital gains tax arrangements around investment properties, a freedom of information request by Sky News Australia has revealed.

More than 1000 Treasury documents classed as advice to Jim Chalmers about changing negative gearing and capital gains tax arrangements

The department has refused to release the documents to Sky News Australia on the basis it says it would be too much work for the department's staff to process the request. "Documents capture in the broad scope of the request include work on the Tax Expenditures and Insights Statement and other routine work." Treasurer Jim Chalmers told Sunday Agenda on February 11 that he had been briefed about different elements of negative gearing and capital gains but he said he had no plans to make such changes.

Mr Kennedy responded:"I talk to the Treasurer about every single part of the tax system. In fact we published a report a couple of weeks ago called the Tax Expenditure Insight Statement that shows the distributional features of all parts of the tax system including negative gearing. So I'm talking to him about all parts of the tax system."
