In new court documents, Private Media, the publisher of online news website Crikey, says there was no ‘scheme’ to make money from Lachlan Murdoch’s defamation claim.
, has stepped up its legal battle with Lachlan Murdoch, claiming the Fox Corp boss is “morally and ethically culpable” for the January 6, 2021, US riots, while denying that it published Murdoch-related articles in a scheme to make money.
Running parallel to the Dominion case is Mr Murdoch’s defamation case against Private Media, which is currently due to go to trial in October. Mr Murdoch claims he was defamed by aHe has named Keane, former editor-in-chief Peter Fray, Private Media, its chairman Eric Beecher and chief executive Will Hayward in the case., Private Media’s lawyer Michael Bradley has introduced a new defence beyond those of public interest and qualified privilege – contextual truth.
In this case, Private Media’s lawyers are drawing from the evidence unearthed in the Dominion case to claim two contextual truth defences. They also say they will trawl for more evidence in the coming months by demanding information from Mr Murdoch through the court discovery process. Second, the publisher argues that Mr Murdoch’s conduct in allowing Fox News to promote the stolen election lie makes him culpable.
