Media lawyer Justin Quill said he would be 'amazed' if the cost of Ben Roberts-Smith's defamation case was as low as the $25 million that has been publicly reported, claiming it could reach as high as $40 million.

Mr Quill explained that although Nine had not proven every one of their imputations against Mr Roberts-Smith, they had succeeded in proving that the most significant claims were “substantially true”.

“The murder allegation effectively swamps those other allegations. Those other allegations don't harm his reputation any more than calling him, correctly, a murderer.” “The standard of proof in a criminal case is beyond reasonable doubt. Everyone knows that. In a civil case, it's normally the balance of probabilities. That means that it's more probable than not that he did this,” Mr Quill said.
