Trump gag order hearing: U.S. Judge Tanya S. Chutkan to hear arguments over special counsel’s request to narrowly limit what Trump can say about election case in D.C.
Judge Tanya S. Chutkan started the hearing by summarizing what the government had asked for and explaining that she allowed the Justice Department to file its request partially under seal to redact the names of people they say were threatened and harassed after being lambasted by Donald Trump. She then moved to an issue she thought would be “simpler” to resolve than limitations on speech — guardrails on what Trump can ask in surveys that would be sent to D.C.
residents cannot be fair and impartial, but prosecutors expressed concern that the questions would be slanted in a way that would prejudice potential jurors. “I see little reason to impose much in the way of survey requirements,” she said. The defense has agreed to notify Chutkan when they plan to survey jurors and how big the sample size is. “There is a low probability that anyone polled will end up” as a potential juror, she said, as most such surveys only involve a few hundred people.
