The victim of an alleged rape and assault near a popular Darwin beach suffered "quite severe" injuries that required surgery, a court has been told.He has been charged with sexual intercourse without consent and aggravated assaultA 29-year-old man, who cannot be named for legal reasons, today faced the Darwin Local Court charged with sexual intercourse without consent and aggravated assault.in the city's northern suburbs last Friday night.
In seeking bail, the man's lawyer, Gabriel Chipkin, told Judge Michael Carey he conceded the allegations were "extremely serious" and the presumption was against bail."The allegations, in that context, do appear to be out of character," Mr Chipkin said.Mr Chipkin also said his client would abide by any bail conditions the court wished to impose, and that the man's employer had also offered to put up a $5,000 surety.
He said if the accused man was not granted bail, he would likely be remanded in custody for about 12 months if the case ended up before the Supreme Court. "He is facing a very significant period of incarceration if he's not granted bail," the defence lawyer said. The judge rejected the application, saying it was an "extremely serious case"."It appears on its face to be a relatively strong crown case.Judge Carey remanded the man in custody until his next court appearance on October 28.
