A man allegedly killed his sister’s ‘nuisance’ ex in a sustained knife attack after ‘taking the law into his own hands’, a trial has heard.

Prosecutor Neil Fryman told jurors that there was no evidence that Dylan was armed, and said he had not previously attacked Mr Fosbrook. “The defendant could have stayed inside his sister’s house and called the police as he had done days before,” Mr Fryman said. Dylan was made the subject of an Exclusion Order, prohibiting him from contacting Mr Fosbrook’s sister or going near her home address in Offerton, jurors were told. He breached the order on several occasions between June and August 2021 by turning up at her house, it was said.

Mr Fosbrook was then asked by his mum to stay with his sister at her new address on Foliage Crescent, in Brinnington, for the night following concerns that she was ‘suicidal’, and he was later dropped off by the police, Mr Fryman said. In the early hours of the morning of December 17, Dylan was captured on CCTV walking around near the house with a bag. This was said to not have contained any weapons.
