A close relative of Bates, who was found dead at her Cobram home on Tuesday afternoon, said her family had been told murder charges against John Torney were “off the table”.

The family of Emma Bates say police have told them the man who allegedly assaulted her will not be charged with murder after an autopsy could not find a conclusive cause of death.

They said investigators had told the family it meant they were unable to prove Torney’s alleged assault directly caused Bates’ death. The Cocking family said Emma, the fourth of seven children, was a type 1 diabetic who used a mobility scooter and was frequently hospitalised for health issues.“It’s tragic that her big heart has led her to a friendship with a man who wished her harm. No one deserves that,” the family said in a statement released on Thursday morning.

“She was the crazy cat lady aunt. She had her rescues that she treated like her babies. Her home decor was all cat-inspired. Emma wasn’t blessed with children, but was a proud aunty to her 17 nieces and nephews. They were her pride and joy and she would spend hours talking about them to everyone. She had many of their faces tattooed to her leg so she could carry them with her always.”
